San Marcos Council Member Lorenzo Gonzalez Arrested in Austin on Felony Assault Charge

A member of the San Marcos City Council is facing serious legal repercussions after an alleged physical altercation outside a downtown Austin dining establishment over the weekend led to his arrest on a felony charge. Lorenzo Gonzalez, who was elected to his first term on the council earlier this year, was taken into custody by local authorities after allegedly pushing and biting a private security guard who was attempting to manage a disturbance.

Gonzalez, 38, has been formally charged with assault on a public servant, an offense classified under Texas law as a third-degree felony. The high-level charge poses significant legal jeopardy for the local lawmaker and presents immediate governing complications for the municipal leadership in San Marcos, where charter rules dictate severe penalties for elected officials convicted of major crimes.

The confrontation took place on Sunday evening along the 300 block of Lavaca Street in downtown Austin. According to an arrest affidavit filed by law enforcement, Austin Police Department officers were dispatched to the scene at 301 Lavaca St. following reports of an active physical altercation. Incident log records maintained by the department confirmed that officers logged an "assault with injury" call at that precise address at approximately 6:24 p.m.

When responding officers arrived on the scene, witnesses reported that the disturbance had actually consisted of two distinct, consecutive altercations outside an establishment. The affidavit did not name the specific restaurant where the dispute occurred, but it detailed how the unfolding events quickly drew in multiple individuals, including Gonzalez.

The initial incident centered on a man identified in law enforcement documents only as Richard. According to witness statements, Richard had been struck in the face by an unidentified assailant who quickly fled the scene before police units could arrive. While security personnel stationed outside the venue were engaged in conversation with Richard to assess what had happened, Gonzalez reportedly approached the group and initiated a verbal confrontation with the guards.

Court documents do not clarify whether Gonzalez had any personal connection to Richard or to the unidentified assailant who struck him. However, investigators noted that the verbal disagreement between Gonzalez and the security staff escalated rapidly into physical hostility in front of the venue.

To establish the sequence of events, Austin police investigators reviewed surveillance camera footage obtained from an adjacent bar. The video recording reportedly captured Gonzalez in the middle of a heated argument with a security officer. The footage shows Gonzalez pushing the security guard twice, which prompted the guard to push him back in an effort to maintain distance.

Moments later, the situation intensified further as several other security guards approached Gonzalez to assist their colleague and bring the confrontation under control. It was during this physical interaction that Gonzalez allegedly bit one of the security guards on the hand, according to the arrest affidavit.

Officers who examined the guard at the scene reported visible physical trauma consistent with an assault. Charging documents indicate that the bite landed on the fleshy webbing between the security officer's left thumb and index finger, leaving a noticeable puncture wound that was actively bleeding when law enforcement arrived to document the injuries.

The affidavit noted that the victim was wearing a tactical security vest that prominently displayed his security company's name and official emblem. Investigators stated that this distinct gear made him easily recognizable as an on-duty security guard, leading authorities to determine that the incident satisfied the statutory legal requirements for charging Gonzalez with assault on a public servant.

Following his arrest on Sunday, Gonzalez was transported to the Travis County Jail for formal processing. Official judicial records show that he was released from custody the following day, Monday, Sept. 14, after posting a $5,000 bond while awaiting further court proceedings.

Gonzalez represents a relatively new presence on the San Marcos City Council, having first won election to his seat in 2024. However, his continued service on the dais could be abruptly curtailed depending on the ultimate outcome of the criminal proceedings in Travis County.

Under the explicit governance guidelines established in the San Marcos City Charter, any seated city council member immediately and automatically forfeits their municipal office if they are convicted of a felony. Because Gonzalez is facing a third-degree felony charge, a conviction would trigger an immediate vacancy on the council.

In the days following the arrest, key figures involved in the matter have remained largely silent. Gonzalez and his criminal defense attorney, Sandra Ritz, did not return requests seeking comment on the allegations or his defense strategy. Similarly, San Marcos Mayor Jane Hughson declined to provide public comment on Wednesday regarding her council colleague's legal situation.

The municipal government addressed the matter through city spokesperson Nadine Cesak, who indicated that local officials possess no additional details regarding the ongoing case. Cesak emphasized that the arrest is a private legal matter, pointing out that the allegations stem from an incident involving an individual member of the city council acting in a personal capacity rather than in any official municipal role.
