California Lawmakers Advance Measures to Strengthen Midterm Election Security and Transparency

California's legislature has taken significant steps to bolster the integrity of the upcoming midterm elections by approving a series of bills aimed at enhancing ballot security and ensuring transparency in political advertising. As the two-year session draws to a close, these bills are set to be sent to Governor Gavin Newsom for his consideration.

The measures come in the wake of a heightened awareness of potential interference in the electoral process. One of the key bills, proposed by Assemblymember Marc Berman (D-Menlo Park), would require social media influencers who are compensated by political campaigns to disclose their financial ties. This move is in response to the growing influence of influencers in the 2026 gubernatorial primary, where candidates like Democratic billionaire Tom Steyer have paid influencers to promote their campaigns without always making the financial arrangement clear.

Berman's bill mandates that paid content be clearly labeled to prevent voter deception. Failure to comply with these disclosure requirements could result in fines for both influencers and campaigns. The legislation is part of a broader effort to ensure that the electorate is not misled by political messaging.

Additionally, two bills sent to Newsom would criminalize interference with mail ballots and the seizure of election materials. This follows concerns from Democratic lawmakers over potential attempts by President Trump or his supporters to disrupt the electoral process. The bills are a direct response to incidents such as Riverside County Sheriff Chad Bianco's controversial move to seize more than 650,000 ballots over unproven claims of fraud.

Governor Newsom has already signed a bill that prevents law enforcement agencies from taking ballots without a warrant. Assemblymember Gail Pellerin's (D-Santa Cruz) legislation takes this a step further by making it a felony to take or order the seizure of ballots, election records, or voting machines, with penalties up to four years in prison.

"The federal administration and those seeking to spread lies about our democracy continue to call for interference in elections in ways we have never seen before in this country," Pellerin stated. "AB 282 helps ensure that every lawfully cast vote can be counted, and that the will of the voters of every political party will be respected."

Republican lawmakers have argued that the bill is unnecessary, as stealing ballots is already a crime. However, with the midterm elections fast approaching, the passage of these bills underscores the state's commitment to protecting the electoral process.

Another measure, SB 259, makes it a crime to interfere with a mail ballot during transit or to order the seizure of ballots in transit to a local elections office. With Newsom having until September 30th to sign or veto these bills, the state is poised to implement significant changes to safeguard the integrity of its elections.

The legislative package reflects a broader national conversation about the role of social media in politics and the need for transparency in campaign finance. As California continues to lead the way in electoral reforms, these measures could serve as a model for other states looking to strengthen their democratic processes.

The bills' passage comes at a critical time, as the midterm elections are expected to be highly contentious. By focusing on ballot security and transparency, California is taking proactive steps to ensure that the voices of its citizens are heard and counted. As the state moves forward, these new laws will play a crucial role in shaping the future of its electoral system.
